Terms of Service

1. Introduction and Acceptance

Welcome to College Coach ("the App"), a service provided by College Coach AI, LLC ("we," "our," or "us"), a limited liability company incorporated in Wyoming. By downloading, installing, or using the College Coach mobile application or visiting our website at collegecoach.ai (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and College Coach AI, LLC. We encourage you to read them carefully.

2. Eligibility and Minors

2.1 Minimum Age

You must be at least 13 years of age to use College Coach. By using the Service, you represent and warrant that you are 13 years of age or older. Users who indicate they are under 13 during the age verification process will be denied access, and no personal data from those users will be collected or stored.

2.2 Users Ages 13–17

If you are between the ages of 13 and 17, you represent that you have obtained permission from a parent or legal guardian to use the Service and that your parent or guardian has reviewed and agreed to these Terms on your behalf. We encourage parents and guardians to be involved in their teenager's use of College Coach.

2.3 Accuracy of Age Information

You agree to provide your accurate date of birth during the registration process. Providing a false date of birth to circumvent our age requirements is a violation of these Terms and may result in immediate account termination.

3. Account Registration and Responsibilities

3.1 Account Creation

To access the full features of College Coach, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@collegecoach.ai if you suspect any unauthorized use of your account.

3.3 One Account Per User

Each account is for use by a single individual only. Accounts may not be shared between multiple people. If you subscribe to a family plan, each family member must create and use their own individual account.

3.4 Account Termination by You

You may delete your account at any time from within the App by navigating to Settings and selecting "Delete Account." Upon deletion, all personally identifiable information associated with your account will be permanently removed from our systems. You may also request account deletion by contacting us at support@collegecoach.ai.

4. The Service and AI-Generated Content

4.1 Description of Service

College Coach is an AI-powered college planning application that provides personalized college recommendations, high school roadmaps, essay coaching, and related college preparation guidance to high school students.

4.2 AI-Generated Content Disclaimer

The recommendations, roadmaps, essay feedback, and other outputs provided by College Coach are generated by artificial intelligence and are intended for informational and planning purposes only. They do not constitute professional college counseling, academic advising, or any other form of licensed professional advice.

AI-generated content may contain errors, omissions, or information that is not applicable to your specific situation. You should not rely solely on College Coach recommendations when making important decisions about college applications, course selection, or academic planning. We strongly encourage you to consult with your school's guidance counselor, a licensed college admissions counselor, or other qualified professionals as appropriate.

4.3 No Guarantee of Outcomes

College Coach does not guarantee admission to any college or university, any particular academic outcome, or any specific result from using the Service. College admissions decisions are made solely by individual institutions and are subject to many factors outside our control.

4.4 Your Content

When you input information into College Coach — including essays, personal details, and responses during voice coaching sessions — you grant College Coach AI, LLC a limited license to process and use that content solely for the purpose of providing the Service to you.

We do not use your personal content or inputs to train, fine-tune, or improve any AI models, including our own or those of our AI service providers. Your content is processed by our AI providers (Anthropic, AWS Polly, and OpenAI Whisper) exclusively to generate your personalized results, consistent with our Privacy Policy.

5. Subscriptions and Billing

5.1 Subscription Plans

College Coach offers both free and premium subscription tiers. Premium features are available through a paid subscription, which may be offered on a monthly or annual basis. Family plans are also available, allowing multiple family members to each maintain their own individual account under a single family subscription.

5.2 Billing Through Apple

All purchases, subscription billing, renewals, cancellations, and refunds are processed exclusively through Apple's App Store and are governed by Apple's own terms and conditions. College Coach AI, LLC does not directly handle payment information and has no ability to process refunds outside of Apple's systems.

5.3 Subscription Renewals

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You can manage and cancel your subscription at any time through your Apple ID account settings.

5.4 Price Changes

We reserve the right to adjust subscription pricing. Apple will notify you of any price changes in accordance with their policies prior to your next renewal date.

5.5 Free Trials

We may offer free trial periods from time to time. If a free trial is offered, the specific terms and duration will be clearly disclosed before you begin the trial. Your subscription will automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand through your Apple ID settings.

6. Acceptable Use

6.1 Permitted Use

You may use College Coach solely for your personal, non-commercial college planning and academic preparation purposes.

6.2 Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Provide false or misleading information, including a false date of birth
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the App
• Use the Service to generate content for commercial purposes or to resell to others
• Interfere with or disrupt the integrity or performance of the Service
• Use automated scripts, bots, or other means to access the Service in a manner that places excessive load on our infrastructure
• Attempt to circumvent any age verification, subscription, or access control mechanisms
• Share your account credentials or allow others to access the Service through your account

6.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account at our sole discretion if we determine that you have violated these Terms, engaged in fraudulent activity, or used the Service in a manner that is harmful to other users or to us. In the event of termination for cause, you will not be entitled to a refund of any prepaid subscription fees.

7. Intellectual Property

7.1 Our Content

All content, features, and functionality of the Service — including but not limited to the app interface, design, text, graphics, logos, and software — are owned by College Coach AI, LLC or its licensors and are protected by applicable intellectual property laws.

7.2 Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device solely for your personal, non-commercial use in accordance with these Terms.

7.3 Feedback

If you submit feedback, suggestions, or ideas about the Service to us, you grant us the right to use that feedback without any obligation to compensate you.

8. Disclaimers and Limitation of Liability

8.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8.2 Limitation of Liability

To the maximum extent permitted by applicable law, College Coach AI, LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to us (through Apple) in the twelve months preceding the claim.

8.3 College Admissions

We expressly disclaim any liability for college admissions outcomes, scholarship results, or any academic or career consequences arising from your use of or reliance on the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless College Coach AI, LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, available at collegecoach.ai/privacy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

11. Third-Party Services

The Service integrates with third-party services including Apple's App Store, Anthropic (Claude AI), Amazon Web Services (including AWS Polly), and OpenAI (Whisper). Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services.

12. Modifications to the Service and Terms

12.1 Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

12.2 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you through the App or via email. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

13.2 Informal Resolution

Before filing any formal legal claim, you agree to contact us at support@collegecoach.ai and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally.

13.3 Jurisdiction

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Wyoming, and you hereby consent to the personal jurisdiction and venue therein.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and College Coach AI, LLC regarding your use of the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
